Welcome to elitebioperformance.com (the "Site"), operated by Titan Production Group LLC, doing business as Elite Bio Performance ("we," "us," or "our"). By placing an order through our Site, you agree to the following terms and conditions.

1. Products and Pricing

All products sold through Elite Bio Performance are sourced from authorized manufacturers and distributors. We are an authorized dealer for every brand listed on our Site. All products include full manufacturer warranties.

Prices are listed in US Dollars (USD) and are subject to change without notice. We reserve the right to correct pricing errors at any time. If a pricing error is identified after an order is placed, we will contact you before processing the order.

2. Orders and Payment

All payments are processed securely through Shopify Payments. We accept major credit cards and financing through approved third-party providers (Affirm/Klarna, where available).

By placing an order, you authorize us to charge your selected payment method for the total order amount, including applicable taxes and shipping fees.

Orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability.

3. Shipping and Delivery

Most products ship via LTL (Less-Than-Truckload) freight carriers from the manufacturer's US-based warehouse. Typical transit times are 5–12 business days after shipment, depending on your location and the manufacturer's fulfillment schedule.

Free standard freight shipping is included on all orders over $3,000.

White Glove Delivery (inside placement, liftgate, packaging removal) is available starting at $299 for qualifying products and locations.

Delivery timelines are estimates and not guaranteed. We are not responsible for delays caused by carriers, weather, or circumstances beyond our control.

4. Mandatory Freight Inspection Policy

THIS SECTION IS A MATERIAL TERM OF YOUR PURCHASE.

All orders shipped via freight carrier are subject to our Mandatory Freight Inspection Policy. By placing an order, you acknowledge and agree to the following:

a. You must inspect all packaging at the time of delivery, BEFORE signing the carrier's Bill of Lading (BOL). Inspect for visible damage including punctures, crushing, dents, water marks, or torn packaging.

b. If ANY damage is visible, you must: (i) note the damage in detail on the BOL (e.g., "dent on left side of crate, torn shrink wrap"), (ii) take timestamped photographs of all visible damage, and (iii) contact us within 48 hours at support@elitebioperformance.com with photos and a written description.

c. If damage is severe, you have the right to refuse the shipment entirely. Write "REFUSED — DAMAGED" on the BOL and contact us immediately.

d. If you sign for a shipment without noting visible damage on the BOL, you assume responsibility for any transit-related damage. Elite Bio Performance cannot guarantee a replacement, refund, or freight claim for damage that was not documented at the time of delivery.

This policy exists to protect you. Freight carriers' liability is significantly reduced once a shipment is signed for as received in good condition. Proper documentation ensures we can file a successful freight claim and get you a replacement at no cost.

5. Returns and Exchanges

5a. Damaged or Defective Products

If your product arrives damaged (with damage documented on the BOL per Section 4) or is manufacturer-defective, contact us within 48 hours of delivery. We will coordinate a replacement at no cost to you, including return freight if necessary.

5b. Change-of-Mind Returns

We accept returns on unopened, unused, unassembled products in original packaging within 30 days of delivery, subject to the following:

A 25% restocking fee applies. This fee covers the cost of return freight coordination, product inspection, repackaging, and restock processing for oversized equipment (100–500+ lbs).
Return shipping costs are the buyer's responsibility. We will coordinate the return freight pickup and provide you with the shipping cost before proceeding.
Products must be in original, factory-sealed packaging. Products that have been assembled, installed, used, or returned without original packaging are not eligible for return.

5c. Non-Returnable Items

The following items are final sale and cannot be returned: custom or made-to-order products, products that have been assembled or installed, products returned without complete original packaging, and products marked as "Final Sale" at the time of purchase.

6. Order Cancellations

Before shipment: Orders cancelled before the product has shipped will receive a full refund minus a 3% administrative fee. This fee covers the non-refundable credit card processing costs incurred at the time your payment was processed.

After shipment: Orders cancelled after the product has shipped are subject to the 25% restocking fee (Section 5b) plus return freight costs, as the product is already in transit or delivered.

7. Warranty

All products sold by Elite Bio Performance include the full manufacturer's warranty as specified by the original manufacturer. We are authorized dealers and all warranties are valid and enforceable.

Warranty claims should be directed to us first at support@elitebioperformance.com. We will coordinate with the manufacturer on your behalf to resolve warranty issues as quickly as possible.

Elite Bio Performance does not provide any additional warranty beyond the manufacturer's original warranty.

8. Product Disclaimers

General Wellness Products

The products sold on this Site — including cold plunges, infrared saunas, and red light therapy panels — are classified as general wellness products. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease.

Hyperbaric Chambers

The mild hyperbaric oxygen therapy (mHBOT) chambers available on this Site operate at 1.3–1.5 ATA and are intended for personal wellness use only. They are not FDA-cleared medical devices. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

If you are considering hyperbaric therapy for a medical condition, consult your physician before purchasing. Contraindications for mHBOT may include uncontrolled lung disease, recent ear surgery, untreated pneumothorax, and pregnancy.

Safety Warning: Never bring electronic devices, battery-powered equipment, or any potential ignition source inside a hyperbaric chamber. The oxygen-enriched environment significantly increases fire risk.

9. Limitation of Liability

To the maximum extent permitted by law, Elite Bio Performance (Titan Production Group LLC) shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from or related to your purchase or use of any product sold on this Site.

Our total liability for any claim arising from a product purchase shall not exceed the purchase price of the product in question.

10. Indemnification

By purchasing from this Site, you agree to indemnify and hold harmless Titan Production Group LLC, doing business as Elite Bio Performance, its owners, employees, and agents from any claims, damages, or expenses arising from your use of any product purchased from this Site.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to conflicts of law provisions. Any disputes arising from these terms or your use of this Site shall be resolved in the courts of Orange County, California.

12. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. Changes are effective immediately upon posting to this Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised terms.
